Terms and Conditions

Super Trekkers (OPC) Private Limited (CIN: U79120MH2023OPC410608) is a company registered under the Companies Act, 2013. We’re thrilled to help you explore the mountains, valleys, and trails through our carefully curated trekking expeditions, adventure tours, and custom travel experiences across India and select International destinations.

These Terms & Conditions explain how our services work, what you can expect from us, and what we ask of you in return. By booking a trek, expedition, or using our website/platform, you acknowledge and agree to these terms.

Booking any trekking, adventure, or travel experience (“Trip”) with Super Trekkers constitutes unconditional acceptance of the terms and conditions set forth herein and forms a legally binding contract between Super Trekkers and the Participant.


PART A: GENERAL PLATFORM USE & TERMS OF SERVICE

1. Introduction

These terms govern your access to and use of our website www.supertrekkers.com, our booking portal, and related digital services. By using our platform or booking a Trip, you acknowledge and agree to these Terms.

2. Eligibility

  • Participants must be 18 years or older to book a Trip, or have parental consent if under 18.
  • All information provided during booking must be accurate and complete.
  • Super Trekkers reserves the right to deny participation or cancel bookings if eligibility or conduct standards are not met.

3. Website & Content

  • All content including itineraries, images, videos, blogs, and designs are the intellectual property of Super Trekkers (OPC) Private Limited.
  • You may not reproduce, distribute, or use our content for commercial purposes without written consent.

4. Third-Party Links

Our platform may link to third-party services (hotels, transporters, insurance, etc.). Super Trekkers is not responsible for the content, policies, or actions of any third-party website or provider.

5. Privacy & Data Use

Your personal information is collected and processed in accordance with our Privacy Policy. By using our services, you consent to receive communication (calls, SMS, emails) for bookings, trip updates, or marketing purposes.


PART B: TRAVEL & TREKKING SERVICE TERMS

1. Acceptance of Risk & Participant Responsibility

1.1. Trekking and adventure travel involve inherent risks including injury, illness, loss, or death due to natural, environmental, or human factors.
1.2. By booking a Trip, you voluntarily assume all such risks and agree to be responsible for your safety, physical fitness, and decision to participate.
1.3. You must disclose any medical condition or medication prior to booking.
1.4. Super Trekkers takes all reasonable precautions but cannot guarantee a risk-free experience.


2. Booking & Payments

2.1. Booking a Trip implies acceptance of this Agreement by all participants listed in the booking.
2.2. Verify all Trip details, including dates and documents, before making payment.
2.3. Full or partial payment must be made as per our stated schedule. Late payments may result in cancellation without refund.
2.4. Refunds (if applicable) are processed within 15–30 working days.
2.5. Any payment made via discounts, vouchers, or promotional offers is non-refundable and non-transferable.


3. Minor Participation Policy

  • Participants under 15 years must be accompanied by a parent or guardian.
  • Participants aged 15–18 years may join solo with a signed parental consent form.

4. Documentation & Permits

All required identification, health forms, and trek permits must be submitted before the Trip. Super Trekkers will not be liable for denial of services due to missing or invalid documentation.


5. Insurance Advisory

We strongly recommend that all participants obtain comprehensive travel and high-altitude insurance covering medical emergencies, evacuation, and trip cancellations. Super Trekkers is not responsible for any disputes between participants and insurance providers.


6. Amenities & Local Conditions

Trekking destinations are often located in remote areas with limited facilities. Conditions such as weather, terrain, and logistics may affect comfort levels. Participants must accept these challenges as part of the adventure experience.


7. Expenses & Exclusions

Unless explicitly stated in the itinerary, Trip cost does not include:

  • Airfare, visa, or travel documentation costs.
  • Insurance or evacuation expenses.
  • Personal items, phone bills, tips, beverages, laundry, or optional activities.

8. Luggage & Belongings

All personal belongings remain the participant’s responsibility. Super Trekkers is not liable for loss, theft, or damage of luggage or personal items.


9. Force Majeure

Super Trekkers shall not be held responsible for cancellations, delays, or changes due to events beyond its control, including:

  • Natural disasters (earthquakes, landslides, floods, snowfall, etc.)
  • Political unrest, strikes, curfews, or government restrictions.
  • Road blockages, permit cancellations, or pandemics.

No refund or compensation shall arise from such events.


10. Itinerary Changes

Super Trekkers reserves the right to modify, shorten, or cancel itineraries in case of weather, road closures, health emergencies, or other unforeseen circumstances.
Any additional expenses due to such changes are borne by the participant.


11. Cancellation & Refund Policy

  • No refunds or vouchers will be issued for voluntary withdrawal, missed departures, or non-utilization of services.
  • If Super Trekkers cancels a Trip before departure, participants may choose between:
    1. An alternate trek/date
    2. A credit voucher valid for 12 months
    3. Transfer to another trip (subject to cost difference)
  • If a Trip is terminated after commencement, no refund will be issued.
  • Super Trekkers is not liable for external expenses like flight tickets or visas.

12. Medical Emergencies & Evacuation

In case of illness, injury, or evacuation:

  • All related expenses (hospital, doctor, helicopter, transport) are borne by the participant.
  • Super Trekkers will assist in coordination but is not financially responsible.

13. Conduct & Discontinuation Policy

Super Trekkers reserves the right to remove any participant from the Trip for:

  • Misconduct, intoxication, abusive behavior, or violation of safety rules.
  • Health conditions such as AMS, low oxygen (<80%), or unfit physical state.
    No refund will be provided under such circumstances.

14. Third-Party Manpower & Vendors

Super Trekkers engages third-party porters, guides, and service providers. While we ensure their reliability, we are not liable for their personal actions, delays, or non-performance.


15. Photography & Media

By joining a Trip, participants grant Super Trekkers a royalty-free, perpetual license to use trek photos/videos for promotional and social media purposes.
Participants who do not wish to appear in media must inform us in writing before the trek.


16. Complaints & Dispute Resolution

All service-related concerns must be reported during the trek to the trip leader or coordinator.
Post-trip complaints must be emailed within 7 days of completion to:

If unresolved, disputes shall be subject to arbitration under Indian law, conducted in Mumbai, Maharashtra.


17. Governing Law & Jurisdiction

This Agreement is governed by the laws of India.
All disputes shall fall under the exclusive jurisdiction of courts in Mumbai, Maharashtra.


18. Modification of Terms

Super Trekkers reserves the right to update, modify, or remove any of the above Terms without prior notice. The latest version will always be available at:

Acknowledgement

By booking a Trip, the Participant confirms that they have read, understood, and agreed to all Terms & Conditions of Super Trekkers (OPC) Private Limited.

IN WITNESS WHEREOF, the Participant accepts and agrees to abide by this Agreement.
